1. Acceptance

By creating an account or using Wishgate, you agree to these Terms of Service ("Terms"). If you do not agree, do not use the platform. If you are using Wishgate on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. Who Can Use Wishgate

You may use Wishgate if you are at least 16 years old (or the age of digital consent in your jurisdiction) and are not prohibited by applicable law. Accounts for organizations (studios or creator channels) must be registered by a person with authority to act on behalf of that organization.

3. Account Responsibilities

You are responsible for maintaining the security of your account credentials.
You must provide accurate information and keep it up to date.
You may not share account credentials with third parties or create accounts on behalf of others without their consent.
You are responsible for all activity that occurs under your account.

4. Organization Types and Use

4.1 Studios

Studios use Wishgate to list games, create partnership opportunities, recruit content creators, and manage campaign deliverables. Studios must:

Own or have rights to the games they list
Provide accurate game information and Steam AppIDs
Honor reward commitments (keys, payments) made to creators
Not misrepresent game status, features, or compensation

4.2 Creators

Content creators use Wishgate to discover partnership opportunities, apply to games and events, and submit content deliverables. Creators must:

Accurately represent their channel, audience size, and content type
Connect only platforms they genuinely own
Fulfill partnership commitments in good faith
Not misrepresent content deliverables or submit fraudulent submissions

5. Content and Conduct

You agree not to:

Upload content that violates any law or third-party rights (intellectual property, privacy, defamation)
Use the platform to harass, abuse, or spam other users
Attempt to circumvent platform fees or subscription requirements
Scrape, reverse-engineer, or abuse Wishgate's systems
Create fake organizations, artificially inflate social metrics, or misrepresent partnership status
Use Wishgate to distribute malware, phishing content, or other harmful material

We reserve the right to remove content and suspend or terminate accounts that violate these Terms.

6. Intellectual Property

6.1 Your Content

You retain ownership of content you upload (game descriptions, logos, chat messages, etc.). You grant Wishgate a non-exclusive, worldwide, royalty-free license to host, display, and transmit your content for the purpose of operating the platform.

6.2 Wishgate's Content

The Wishgate platform, design, code, and branding are our property. You may not copy, modify, or redistribute them without written permission.

7. Subscriptions and Payments

Subscriptions are billed via Stripe on a monthly or yearly cycle.
All prices are stated in euro (EUR) and are exclusive of VAT. Any value-added tax, sales tax or equivalent required by your billing country is calculated and added at checkout, and is shown to you before you confirm payment.
Business customers in the EU outside Bulgaria who supply a valid VAT identification number at checkout are invoiced under the reverse-charge mechanism and pay the listed price without VAT. You are responsible for the accuracy of the VAT number and billing address you provide.
Yearly plans are priced at 10× the monthly rate (2 months free).
Subscriptions auto-renew until cancelled. You may cancel auto-renewal at any time from your organization settings.
We reserve the right to change pricing with 30 days' notice for existing subscribers.

8. Admin Approval

Organization accounts and game listings require admin approval before becoming active on the platform. We may reject or suspend any account or listing at our discretion, including for violations of these Terms or for business reasons.

9. Partnerships Between Users

Wishgate facilitates connections between studios and creators but is not a party to any partnership agreements. We are not responsible for:

The quality of content created by creators
Studios' fulfillment of reward commitments
Disputes between studios and creators

We provide tools (audit log, rejection reasons, submission tracking) to help resolve disputes, but resolution is the responsibility of the parties involved.

10. Termination

You may delete your account at any time from account settings.
We may suspend or terminate accounts for violations of these Terms, extended inactivity, or legal requirements.
On termination: your profile and organization data will be anonymized per our Privacy Policy. Partnership audit records and chat messages may be retained per legal requirements.

11. Disclaimer of Warranties

The platform is provided "as is" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee uninterrupted service or error-free operation.

12. Limitation of Liability

To the maximum extent permitted by applicable law, Wishgate's liability for any claim arising from your use of the platform is limited to the amounts you paid us in the 12 months preceding the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages.

13. Governing Law

These Terms are governed by the laws of Bulgaria. Disputes will be resolved by the competent courts of Bulgaria, except where mandatory consumer protection laws in your jurisdiction provide otherwise.

14. Changes

We may update these Terms at any time. Material changes will be notified by email or in-app at least 14 days before taking effect. Continued use after the effective date constitutes acceptance.
